Training Provider Terms and Conditions.
This agreement with your company is not exclusive and we may require to use other training providers, who offer similar courses.
Our Terms and Conditions give all Providers 28 days notice of cancellation, if we have insufficient numbers to run a course. Our Group Administrator will contact you and it will then be your decision, to allow us time to try to fill the course by an agreed date, or to cancel with no charge to the Training Group.
A delegate list will be e-mailed/faxed to you prior to the course start and should any delegate not attend a course by 9.15am, please contact Jody Freer or Viktoriya Law at the above Office, so the Employer can be informed.
Any enquiries for in-house courses from companies will be passed to yourselves to arrange the training directly with the companies. In these cases, please provide us with a copy of the attendance record, but deal directly with the companies for payments, dates etc.

CONSTRUCTION INDUSTRY TRAINING BOARD
RULES FOR GROUP TRAINING ASSOCIATIONS SERVICED BY CITB
The Training Group has been formed by a number of employers with activities in the construction industry for the purpose of organising and co-ordinating training.
Name
- The Name of the GROUP (“the group”) is: Highland Construction Training Group
Objectives
- The objectives of the GROUP are:
- To organise and co-ordinate training activities in the construction industry as may be required by the members.
- To co-operate and liaise with Training Enterprise Councils or Local Enterprise Companies in order to promote the training needs of the Construction Industry.
- To co-operate with local training providers and other authorities as regards the provision of facilities for training leading to the award of NVQs/SVQs.
- To do all such things as may be conducive to the attainment of all or any of the above objectives.
Membership Subscription
- The GROUP shall be open to all firms or companies registered with ConstructionSkills and to others provided that the majority are within scope to ConstructionSkills. The first members of the GROUP shall be those whose names and addresses are subscribed in the Schedule attached to these Rules. Prospective members may be admitted to membership on making written application to the Group Committee set up under Rules 8 to 12 in such form and containing such information as the Group Committee may require.
- Save as mentioned in Rule 5 every member shall be and remain a member of the GROUP for an initial period of one year. Subject to this requirement any member may cease to be a member on giving to the Group Committee not less than six months’ previous notice.
- The Group Committee shall have power by notice in writing to a member summarily to terminate membership of the GROUP in any of the following events:
- If such member shall fail to pay the annual subscription within two months after it has become due.
- If being an individual they shall become bankrupt or make any arrangement or composition with their creditors.
- If being a corporation it shall go into liquidation whether voluntary or compulsory or otherwise be dissolved.
- If being a partnership the partnership shall be dissolved whether by agreement between the partners or by operation of the law.
- If a resolution for the expulsion of such members be proposed at the meeting of the Group Committees and be passed without a dissenting vote by any other member.
- To allow the balance of members to be adjusted should out-of-scope organisations become a majority (refer to rule 3, paragraph 1 above)
- A member who ceases to be a member for whatever cause shall cease to have any claim upon the GROUP its assets and funds and shall cease to be entitled to any of the benefits and privileges of membership.
- The Group Committee shall in advance of each financial year determine the rate of subscription for such year, the method by which it shall be calculated and the date or dates on which it shall become payable having regard to the funds expected to be required for the purpose of the GROUP in that year. Every member of the GROUP shall pay the subscription as so determined.
Group Committees
- There shall be a Group Committee, which may form executive Sub-Committees as provided by rule 14.
- Each member shall forthwith nominate in writing one person to act as its representative and the persons so nominated shall comprise the Group Committee.

Each member shall also be entitled to nominate another person as a deputy to act as its representative on the Group Committee in the absence of the original nominee.
- Each member shall be entitled at any time to revoke any subsisting nomination and to nominate another person as its representative or deputy representative.
11. The Group Training Adviser (GTA) responsible for servicing the group for the time being shall normally be in attendance at all meetings of the Group Committee and of all Sub-Committees formed under rule 14 and to this end shall receive notice of all such meetings. The GTA shall not be entitled to vote.
- All representatives of members of the GROUP present at meetings of the Group Committee shall be entitled to vote.
Powers and Duties of the Group Committee
- The GROUP shall be managed by the Group Committee who may pay all such expenses of the GROUP as they think fit and may exercise all the powers of the GROUP and do on behalf of the GROUP all such acts as may be done by the GROUP. The Group Committee may authorise the payment in good faith of reasonable and proper remuneration to any officer or servant of the GROUP or to any member of the group or to any officer or servant of any such member in return for any services actually rendered to the GROUP and for the payment of out-of-pocket expenses properly incurred in the service of the GROUP.
- The Group Committee may from its members, form Sub-Committees as may be requisite for the efficient running of the GROUP. The Group Committees may delegate any of their powers to any such Sub-Committee. The provisions of the Rules shall govern the meetings and proceedings of any such Sub-Committee.
- Without prejudice to the Group Committee Generality of the Rules the Group Committee may:
- restore to membership of the GROUP members whose membership has lapsed by reason of non-payment of subscriptions.
- determine what shall be a sufficient quorum at any meeting of the Group Committee or any Sub-Committee.
- It shall be the duty of the group to:
- A Chairperson, and, if desired, a Vice Chairperson;
- A Treasurer (who shall not be an employee of CITB or the Group);
- A Secretary if not appointed under Rule 23.3;
- make regulations for the keeping of a register of members of the GROUP and of their representatives and deputies;
- Make regulations for recording minutes of all meetings.
Meetings of the Group Committee
- Meetings of the Group Committee shall be held as required (not normally being less than two in each calendar year) and shall be convened by the Secretary at any time at the request of the Chairperson or of any other two members of the Group Committee.
- The Chairperson shall preside at every meeting and in their absence the Vice Chairperson (if any) shall preside. In the absence of the Chairperson and any Vice Chairperson the members present shall choose one of their members to act as chairperson.
Annual General Meeting
- Once in every calendar year one of the meetings shall be termed an Annual General Meeting.
- The appropriate ConstructionSkills Area Manager/Scottish Manager shall be invited to attend The Group Annual General Meeting.
- The business of the Annual General Meeting shall include the consideration of:
(a) The Groups annual report:
- the annual Training Plan for the ensuing year;
- the audited accounts for the year ended; and
- The subscription rate for the ensuing year.
- Not less than seven days’ previous notice in writing shall be given of every meeting other than an Annual General Meeting and not less than fourteen days’ previous notice in writing shall be given of an Annual General Meeting. All notices shall specify the business to be undertaken and any resolutions to be considered and with the notice convening an Annual General Meeting shall be sent a copy of the audited accounts of the GROUP intended to be considered at the meeting together with copies of papers related to the items shown at 20 (b), (c) and (d).
- Notices shall be sent to all members of the GROUP and in the case of an Annual General Meeting notices shall also be sent to the auditor.
Group Training Adviser
- The GTA shall be nominated by the Area Manager of the Area in which the GROUP is resident.
The main duties of the Group Training Adviser will be:
- The establishment and maintenance of a comprehensive training and advisory service to all member companies of the Group Training Association.
- To secure a service from ConstructionSkills relating to the operation of the ConstructionSkills New Entrant Training Programme for delivery in member companies.
- To act as Secretary to the Group Training Association.
- To prepare in association with member companies an Annual Training Plan for the Group.
Management, Safety & Supervisory Training
- The GTA will provide advice and assistance to member companies on Management, Supervisory and Safety Training issues. In the event of the Group requiring the services of ConstructionSkills Direct Training Units this must be paid for by the Group at the current rates pertaining. Such specialist services will include facilitating, organising or providing training in the Management, Supervisory and Safety Training field.
The above is in line with current ConstructionSkills policy on Management, Supervisory and Safety Training.
Finance and Accounts
- The Group Committee shall determine the financial year of the GROUP.
The accounts of the GROUP shall be prepared annually in respect of each financial year and certified by the auditor of the GROUP and submitted for approval to the Annual General Meeting.
Trustees and Investments
The Group Committee may appoint not less than two and not more than four trustees of the GROUP who shall hold office during the pleasure of the Group Committee and subject to regulations made by the Group Committee.
- The assets of the GROUP (other than cash, which shall be in the control of the treasurer) shall be vested in trustees so appointed as aforesaid and be dealt with by them, as the Group Committee shall from time to time direct.
The trustees shall be indemnified against all liabilities and expenses incurred in the course of their duties out of the assets of the GROUP other than such as shall be caused by the default or misconduct of that one of the trustees sought to be made liable.
ConstructionSkills
- The GROUP and all officers of the GROUP for the time being shall at all reasonable times afford to ConstructionSkills such reasonable information concerning the affairs of the GROUP as may be required, including giving access to and the opportunity to take extracts from all its books and records. It is the duty of ConstructionSkills to make available a representative to attend meetings of the Group Committee and other Committees and they shall receive notice for all such meetings. They shall not be entitled to vote.
Dissolution
30.
- The group may be dissolved by Resolution of the Group Committee passed by a majority of not less than three-quarters of such members as, being entitled so to do, vote thereon, and at a Meeting called not less than 21 days’ notice, of which 21 days’ is also given to ConstructionSkills. To constitute a quorum for such a meeting at least three-quarters of the members entitled to attend and to vote shall be present either in person or by proxy. Votes on Resolution to dissolve the GROUP may be given either personally or by proxy. The instrument appointing the proxy shall be in writing in a form prescribed by the Group Committee and shall be lodged with the secretary of the Group before the Meeting.
- If at any time the Group is dissolved then the Group Committees all be responsible for providing ConstructionSkills within seven days a copy of the agreed resolution to dissolve. If at any time the GROUP is dissolved and thereafter remain, after the satisfaction of all debts and Liabilities, any funds or assets, the same shall be either gifted to a body with similar aims and objectives as the Group Training Association or be divided equally amongst the members of the GROUP.
The members of the Group Committee and the officers for the time being of the GROUP shall be indemnified out of the funds of the GROUP against all costs, charges. Losses, damages and expenses which they shall respectively incur or be put to on account of any act, deed, matter or thing which shall be executed, done or remitted by them respectively in good faith in or about the execution of their respective offices.
Interpretation and Amendment
- The Group Committee shall be sole authority for the interpretation of the Rules: and the decisions of the Group Committee upon any questions of the interpretation or upon any matter affecting the GROUP and not provided for by the Rules shall be final and binding upon the members.
- The Rules may, subject to the written approval of ConstructionSkills, be added to, repealed or amended by Resolution of the Group Committee passed by a majority of not less than two-thirds of such members as, being entitled so to do, vote thereon and at a meeting called on not less than 14 days’ notice and at which the quorum shall not be less than one-half of the members entitled to vote at the meeting.
ADDITIONAL RULES
- When a course booking form is received the Company is responsible for paying for the booking unless cancellation is made giving at least 14 days notice to give time to rebook the places.
- The group will put a deadline on the return of quotations from training providers this must be strictly adhered to for the group to accept a provider’s quote.
Training providers will be given 28 days notice by the group if they need to cancel a course due to lack of bookings from members, the training provider will then choose to allow the group an agreed period of time to fill the course or to cancel the course.

COURSE CRITERIA
1. For Whom the Training is Intended:
This should clearly define the category of trainee. Training aimed at too wide a range of participants has only limited benefit to individual trainees.
2. The Aim of the Training
For example: ‘The aim of the course is to train selected people in the skills and knowledge needed to achieve the standards of competence to carry out the
duties of…..’
3. The Training Objectives
These must be clearly defined, directly relevant to the trainee’s needs and be attainable in the time available. They must state what the trainee will be able to do at the end of the training and the conditions under which the trainee will be able to do it.
4. A Training Programme
The programme should define the topic areas to be covered and indicate the minimum duration of each. The programme needs to show breaks but not include these in the 6 hours for a training day.
5. Qualifications/Experience of Training Staff
6. The Ratio of Instructors to Trainees.
7. Achievement Measurement
The method by which the achievement of trainees will be measured during and at the end of the training.

The Principles of Sound Training
Employers should follow the Principles of Sound Training. The method of applying these principles
will vary widely depending on the size of the firm, whether professional training and personnel staff
are employed, and the type of training and development that is under consideration. The objective
should be to make the principles work in a manner that suits the individual firm. The principles of
sound training include:
• The ultimate responsibility for training and development within a firm rests with senior
management. Training and development of workers should be seen as a responsibility of every
individual who is in a supervisory position.
• Training and development should be based on an assessment of the performance required of
individuals and, in order to be cost-effective, should take account of the abilities they possess
before they begin training.
• The training and development programme should be designed to enable the individual to
acquire the necessary skills and knowledge to carry out work safely, to an agreed and
measured level of performance.
• The performance of individuals during their training and development should be monitored,
reviewed at intervals, recorded, and any necessary action taken.
• Training and development policies, plans and programmes will need to be evaluated and
reviewed and, if necessary, updated.
• Training and development should lead to a National Vocational Qualification/Scottish Vocational
Qualification or a credit towards one where possible.
